The Students Council (SC) is a body constituting student leadership in KAGEUSA. At KAGEU, the SC is the KAG EAST University Students Council (KAGEUSC). KAGEUSC is the apex body of the students government and it has a Legislative segment KAGEU, Legislative Council (KAGEULegCo) which is elected by KAGEUSA through an electoral college system (ECS) as provided for by The Universities Amendment Act 2016: Change Of The Student Leadership Structure And Election Process and the Executive segment of the students Government, KAGEU Students Executive Council (KAGEUSEC) which is elected by the KAGEULegCo from the KAGEU student public (KAGEUSA) who are not members of members who are not members of the KAGEULegCo. In this way, the democratic principle safeguarding separation of powers is observed. The Judiciary wing of KAGEUSC is appointed by the KAGEUSEC but assumes office only after being vetted by the KAGEULegCo.
The Student Council, is the apex student leadership wing of the Students Association in the University. It provides a direct link between the students and the Administration Segments of the Institutions day to day activities. The student Council is represented in the University’s Academic Senate by its Chair (President) and at least one other official.
The role of the Council can be compared to that of Members of Parliament in a country, who represent Constituencies. They are either Elected or appointed to represent specific interest areas such as constituencies (Schools and Academic Programs) or special need groups (Clubs, Masculine or Feminine students, International Students, Campus Residents and out of Campus Residents and those with physical disabilities).
In a democratic political fraternity, the role of the Council as a Student Government focuses on Legislative Matters, (Developing, revising and or legitimizing the Student Council Constitution with its allied Policies and Procedures),
Executive matters (Implementing and mainstreaming of the Student Council Constitution and allied Policies into regular student activity frameworks) and Judicial (Interpreting, advocacy and participating in the process that leads to a reasonable verdict on matters of conflicts where grievances are deemed to be associated with the proper understanding Student Council Constitution and its allied policies at the level of implementation)
In the case of KAGEU, the Students Council has a beautiful blend of Legislative, Executive and Judicial leadership roles as well as an added Diplomatic Role (comparable to that of an Envoy or an Ambassador) of harmonizing the Interests of the Students and those of the University’s Administration.
LEGISLATIVE, EXECUTIVE AND JUDICIAL ROLES OF THE STUDENTS COUNCIL
This clarification is for the benefit of all Council Members. The Dean of Students acts as the Chief legal advisor in this area as an ex-officio member.
EXECUTIVE SEGMENT
The Student Council Chair, the Assistant Chair, the Secretary, the Assistant Secretary and the Treasurer are the executives. In addition to this, we shall see later that five Officials that are appointed into Ministerial Positions are also executive. If they are elected at a primary level directly by the students, then we have a Precedential system of government. If they are elected at a secondary level through a vote within a Council that is already constituted, then we have a Parliamentary System of Government. The Interim Student Council Leadership of May –August 2021, is an example of a Parliamentary system of student government.
When you are involved in the business of Planning for Student Semester Activities based on the Universities, year Calendar, (implementing or mainstreaming the Constitution into routine) these are Executive Roles and Responsibilities. The key Leader in this Segment is the Chair (Council President)
LEGISLATIVE SEGMENT
When you are looking at the business of making, creating or revising of Laws (Student Council Constitution and allied Policies or guiding regulative frameworks), you are doing Student Parliamentary business.
This is the Legislative Leadership Segment of Student Government. Informed by The Universities Amendment Act of 2016 on Leadership structure and Elections process this wing of the students government shall be elected through electoral colleges of the students association and shall be distinct in membership from the executive wing of the students Council.
The Executive shall be elected by the Legislature from among students who are not members of the Legislature. The students system of government is therefore a Parliamentary one.
An Interim Student Council may be appointed to hold up all the segments of government, temporally in exceptional circumstances pending a general election.
JUDICIAL SEGMENT
When you are looking at the business of interpreting Laws (Student Council Constitution and allied Policies or guiding regulative frameworks) for the purpose of resolving disputes arising from a violation of any provision in these documents, you are doing Student judicial business. This is the Judicial Leadership Segment of Student Government. The key Leader in this Segment is the Student Council Chief Justice.
These three dockets are based on the Democratic Principle of separation of powers. We have one Government with three segments.
- In an ideal situation, The Student Council Members are leaders of the students Association and are involved in the Executive Legislative and Judiciary wings of Government with clear separation of powers. The principles of regional and gender balance apply in each segment of the student’s government system as stipulated by THE UNIVERSITIES AMENDMENT ACT2016: CHANGE OF THE STUDENT LEADERSHIP STRUCTURE AND ELECTION PROCESS.
In a parliamentary system of government, the Judiciary is appointed by the Executive but are approved by the vote of the executive subsequent to a vetting process.
THE DEAN OF STUDENTS IN THE STUDENTS COUNCIL
The Dean of Students has the role of a “Legal Advisor” to the Students Council. This role is comparable to that of the Attorney General in Parliament
He or She attends meetings in and ex-officio capacity, who may attend some or all the Council meetings, providing the Council with guidance on matters of Legislation (Operational Policies and Procedures). The Dean of Students sits in several committees including; The University management Board, The Academic Senate and The Student's Council as an ex-officio member.
At the level of official appointments, The Dean of Students acts as an umpire in the Election of the Primary Executive wing and as a returning officer (referee) in the Annual General Elections of the Students Council. The Dean of Students office is equally involved in the nomination and or appointment of non- elected members to the students Council in circumstances where elections are not viable (such as over the period of COVID 19 Pandemic of 2020 September).
THE STUDENTS COUNCIL ELECTIONS
Student Council elections are conducted once at the beginning of every academic year. A student can be elected to the council in two consecutive Council Years. One may be eligible for elections after a break of two consecutive years, if the same happens to be a student in session at the time of elections.
This rule does not apply to Council nominations or non- elective appointments. The Dean of Students or an official approved by the same office shall act as the returning officer.
Student elections shall be conducted through a transparent and reasonable or reliable manner in a secret ballot system through manual or electronic means. The mode of elections shall either be face-to-face or virtual. Matters of Gender and national diversity shall be regarded as priorities in elections and appointments to leadership positions as required by THE UNIVERSITIES AMENDMENT ACT2016: CHANGE OF THE STUDENT LEADERSHIP STRUCTURE AND ELECTION PROCESS
TWO TIER ELECTION PROCESS
The KAGEU students Association, (KAGEUSA) which is a member of the Kenya Universities students Association (KUSK) shall hold a two tier Election as recommended by the Universities Amendment ACT 2016 on Change of Student Leadership Structure and Election Process.
LEVEL ONE: ELECTION OF STUDENT REPRESENTATIVES (LEGISLATIVE SEGMENT)
- The Students’ Association shall constitute itself into electoral colleges based on either academic schools, faculties or departments as may be appropriate.
- Each Electoral College Shall elect three persons referred to as ‘representatives’.
- Each of the three representatives shall represent a Constituency of the Electoral College (Such as a program [Education, Counselling Psychology, Business Studies, Community Development, Agriculture and Journalism], or Level of Study [Masters, Degree, Graduate Diploma, Diploma and Certificate]). The Elected persons shall constitute the Students Parliament which is the Legislative segment of the students Government.
- The three representatives from each constituency (student political party) mentioned above (who constitute the Students Association Parliament), shall elect the students Council Executive (who shall constitute the Student Association’s Executive Leadership).
- Not more than two thirds of the executive shall be of the same gender. Matters of Gender and national diversity shall be regarded as priorities in appointments to leadership positions as required by Universities Act of 2016 mentioned herein above.
LEVEL TWO: ELECTION OF STUDENT COUNCIL (EXECUTIVE SEGMENT)
- The three representatives from each constituency mentioned above (who constitute the Students Association Parliament), shall elect the students Council Executive (who shall constitute the Student Association’s Executive Leadership) through secret ballot.
- The candidates for the students’ council Executive shall be nominated by the Electoral colleges (herein referred to as the student Political parties) from among students who are not part of the Elected Representatives (Parliament).
- Not more than two thirds of the executive shall be of the same gender. Matters of Gender and national diversity shall be regarded as priorities in appointments to leadership positions as required by Universities Act of 2016 mentioned herein above

Complementary Executive Segment: The Complementary Executive Cabinet includes those who hold Co-Curriculum Activity Portfolios. For KAGEU, these portfolios include the following:
- Special Member: MINISTER FOR HEALTH, NUTRITION and ENVIRONMEN (Food, Medication, Sanitation, Litter management)
- Special Member: MINISTER FOR SPORTS, RECREATION & ENTERTAINMENT (Games, Refreshments, Performing Arts)
- Special Member: MINISTER FOR SPIRITUAL AFFAIRS (Christian Union Representative)
- Special Member: MINISTER FOR INTERNAL AFFAIRS (Accommodations and Security)
- Special Member: MINISTER FOR JUSTICE AFFAIRS and PERSONS WITH DISABILITY (Ethics, Integrity, Courtesy and Discipline)
All students, especially those intending to contest for leadership positions in the forthcoming elections are advised to familiarize themselves with these provisions.
THE STUDENTS COUNCIL BY- ELECTIONS
Student Council by- elections are conducted when it is determined through a motion or point of notice that an elected official of the council no longer available for official duty or is incapacitated by some debilitating condition and therefore is not capable of fulfilling the responsibilities of the office held. The official elected through a by-election shall assume office for the remaining period preceding the next student council general elections.
THE STUDENTS COUNCIL APPOINTMENTS
Appointments to the student council office shall be made through the Dean of Student’s office in extra- ordinary circumstances where the regular University Calendar is significantly disrupted or when it is deemed that the regular or by-elections are not feasible, practical or reasonable. In special circumstances (such as when the University’s regular Academic Calendar is disrupted by a Pandemic like the COVID 19), the Entire Council shall come into office in Interim capacity through an appointive process driven by the University’s Academic Senate through the Dean of Students Office.
NOMINATION OF STUDENT COUNCIL CANDIDATES
A nominee to the Student Council candidacy shall be expected:
- To have the status as a current ongoing student
- To be a second year student or above (for Degree and Diploma Level students)
- TO be a member of a specific University Constituency or interest group. A Constituency herein is defined as an Academic Program, a school or a Faculty.
- To be an above average student in academic performance
- To subscribe to a political or a Philosophical ideology espoused by a student political party which is limited to the University’s leadership structures and is therefore independent of a regional or a national political party.
- To be of good social standing within the University Fraternity
- To be free from any unresolved disciplinary procedure
CAMPUS STUDENTS POLITICS
In the Context of student leadership, Politics is a term that broadly refers to the art and or skill of leadership, governance or administration. Campus students’ politics therefore is the deliberate, skillful, artistic and intellectually informed and values based participation in student leadership, governance or administration.
THE STUDENTS COUNCIL CHAIR
The Students Council Chair is the Executive President of the Student’s Government. The president heads the Executive wing of the Council. The Assistant to the Chair is the Vice President.
Although the Council has a Chair who is its President, the Council exercises a Parliamentary rather than a Presidential system of Government. This means that the President is more comparable to a Prime Minister rather than a National President.
The President comes in through an Annual General Election and is elected as an Executive (in a second level election) by the Members of the Students Representatives (Legislative Council) through a process facilitated by the Dean of Students.
Using the same process, other Executive positions such as the Assistant Chair, The Secretary, The Assistant Secretary the Council Treasurer and at least three Special Executive Members are established. This is a Republican or a Parliamentary system of Government, rather than a Presidential system, because, the President (Chair or Prime Minister), is not elected directly by the students but indirectly by the Council.
After being elected in this two process (As a Legislator by Students and as an Executive by the Council members), the one who ascends to the Presidency has the Jurisdiction of conferring added Executive responsibilities to a limited number of Student Council Members as Co-Curriculum Activity Ministers (or Cabinet Secretaries).
The Special Executive Member Responsibilities include But Are Not Limited to Health, Nutrition and Environment (Food, Medication, Sanitation, Litter Management), Sports, Recreation & Entertainment (Games, Refreshments, Performing Arts), Spiritual Affairs (Christian Union Representative), Internal Affairs (Accommodations And Security).

The Legislative wing of the Students Council is the Council Plenary made up of all student representatives Elected through Student Association Electoral Colleges to represent constituencies. This Constitutes the Students Parliament. The students Parliament constitutes the official representatives of the students’ body. This wing is headed by the Student Parliamentary Speaker.
The Council’s Legislative Assembly includes those who hold Elective, Nominative or Appointive Jurisdictions representing Academic interest group affairs. These Academic interest groups are the “National” Constituencies of the student nation. These Constituencies are the basis of student Electoral Colleges and Student Political Parties. In situations where the initial team constituting the student legislature, herein referred to as Representatives (through primary elections by the student Association members or appointment by the University administration in exceptional circumstances) are fewer than is practically feasible for the performance of the student representative duties mentioned herein above, a limited number of nominations can be made either by the Lead Executive (Chair or President), subject to approval of the legislature in a vote or through the intervention of the Academic Deans Office to fill up the gaps.
THE STUDENTS PARLIAMENT SPEAKER
The Students Parliament Speaker is the Chair of the Legislative Wing of the Students Government. The Speaker presides over all Council Plenary Meetings and is assisted by a Deputy Speaker. Ordinary students may be invited into Student parliamentary Sessions.
The speaker and the Deputy are elected by the Members of the Students Council. To avoid conflict of interest, upon election, the Speaker eschews all Executive Responsibilities.
STUDENT PARLIAMENTARY STANDING ORDERS
The student Parliamentary standing orders shall be the documented orders governing the procedures of parliament and Student council meetings.
STUDENT ASSOCIATION CONSTITUTION
The former Chief justice in Kenya, Justice David Maraga once said; “Constitutional power is constrained power.” By constrained, he meant, controlled or limited. The KAGEUSA Constitution is the Student Government Constitution at KAGEU, the supreme regulation document within the students’ fraternity, but is subject to the provisions of the KUSC Constitution, the Kenya National Constitution, the Laws of Kenya and the approval of both the University’s Senate and Council.
It regulates all the actions and transactions among students on Campus. It contains policies and procedures of student initiated operations. The Students Parliament constitutes the official representation of the students’ interests.
The policies are developed through the process of plenary debates and a vote by the Students parliament, under the watchful guidance of the Dean of Students who works in direct consultation with the University’s vice chancellor.
The Student’s council shall go through a process of consultations with stakeholders herein namely the students’ body, the faculty and staff of the University in seeking to obtain strategic opinions for developing Legislative (Policy) items.
To become official policy, the Student Parliament Policy proposals shall presented to the University’s Academic Senate through the Dean of Students. The Academic Senate, under the Chairmanship of the University’s Vice Chancellor shall approve or reject the policy proposals.
KAGEUSA CONSTITUTIONAL AMMENDMENTS
Consultation with all stakeholders shall be ongoing in order to amend the current KAGEUSA Constitution to comply with relevant current Laws and Acts of Parliament
THE STUDENTS JUDICIARY LEADERSHIP SEGMENT (STUDENT DISCIPLINE)
The students Judiciary is the segment of student leadership charged with the responsibility of interpreting the Student Government’s Constitution and allied policies as well as providing jury advice to the University’s Disciplinary Committee, Constituted by the Academic Senate on Matters involving conflicts and or violations on matters of Discipline and good demeanor within campus.
The Students Judiciary Committee shall be appointed as an initiative of the students Council Chair in consultation with the Dean of Students, the Deans of Schools and the University’s Vice chancellor and shall comprise of carefully selected students from each department who are regarded in both Academic and Ethical considerations as being the “Top Cream” (the Best Performing Students in academic and virtuous standing).
The total number of Student Judiciary committee membership shall not exceed the total number of academic departments or academic categories in the entire University.
This segment of student leadership shall be headed by a Student Chief Justice and an assistant Chief Justice who shall be appointed through election by members of the students Judiciary Committee.
In a disciplinary process involving one or more members of the student community, whether the litigants are student or staff, the student Judiciary committee shall be represented in both the prosecution and defense segments of the conflict resolution process.
The final verdict of the litigation process, whether regarded as civil or criminal, shall be given by the Chair of the sitting Disciplinary Committee as constituted by the University’s Academic Senate. The Universities relevant Policy Documents and the Students Constitution shall be the reference points for the verdict.
STUDENT COUNCIL TERM OF OFFICE
The term in office of a student Council leader shall expire after one Academic Year (which constitutes two Semesters or Three Trimesters). The students Council Election shall be conducted either on the Second or the Third week of the Academic year commencing in the month of September every year.
